I tried two cases against her “back in the day” and, despite two unanimous DV’s, the memories are still traumatic, as she is unquestionably the most annoying, unprofessional … well, I could go on, but I’m sure you’ve heard it all before.

After the first trial, I actually made a note in my trial notebook for the second case that part of my strategy would be to do everything I could to make the judge and jury members hate her as much as I did. While the second trial was in recess and we were out of the judge and jury’s sight and hearing, I’d do everything I could to inflame her and, once we were back in front of the Court, she fell right into the trap with her usual shenanigans.

Example? As we came back into the courtroom on one occasion to continue jury selection and her cell phone went off, she just kept walking into the robing room to take the call. I stood there staring at her disappearing back and raised my hands, palms up, with this incredulous expression on my face, then heard one of the jurors saying about her, “How unprofessional!”

After the verdict, and Rhona storming out of court, the judge came down off the bench and walked up to me to say, “If I’m ever assigned a trial with her again, I’m going to recuse myself because she’s the most obnoxious attorney I’ve ever seen.”

She’s always in “attack mode” and can therefore be easily baited. She certainly does enough to alienate people herself, but you can help steer her in that direction.

Just play off her antics by appearing hyper-professional and observing decorum when it comes to communicating with the judge, witnesses, jurors and, yes, even Ms. Silverman herself but, when you have her alone, do whatever you can to “fire her up.” She’ll almost certainly fall into it and pull her usual nonsense.

Be aware of what others have said, such as her penchant for holding up medical records and misquoting while “reading” from them and making “speaking offers” of evidence that is clearly inadmissible.

Last suggestion? Have a good supply of Xanax in your trial bag.

I have not tried a case against her, but have done multiple depositions with her. She likes to read things from the chart to the doctors when asking questions and often the note is misquoted, or she adds or subtracts things from the note to suit her questions purpose. She is a handful.

I tried a case with her a while back. Avascular necrosis of the femoral neck. She tried to introduce fresh butcher meat into evidence to show the jury what bone marrow looks like. Creative but thankfully the court wouldn’t let her get away with it . After all how would it be refrigerated the judge wondered out loud!! She was generally inappropriate throughout.
