Certain judges have called us into court and questioned/demanded the codefendants as to their rationale as to why they will not sign the stipulation since there are no cross claims. Usually our response is that this is the procedure as per our insurance carrier despite there being no cross claims. For example when I worked on FOJP cases some years ago they absolutely would not authorize us to sign any stip of discon and they had to be so ordered.
I do believe the court does get frustrated since the plaintiff is voluntarily discontinuing certain parties, it is a waste of the courts time to go through this process of so ordering. Personally, I recommend putting language in the stips that reflect the language below to protect the defendants left in the case. I think thats sufficient. I have some examples if you need.
