2 part question
does anyone know this expert (IM/geriatics/palliative care) who is coning in as an expert in a nursing home case for Silberstein Awad?
The expert’s opinion is that my client, who was Director or the Nursing Home and never saw pt., but issued TO orders, had a responsibility for the Care Plan, the doctors who worked for his PC, the d/c papers, and to see that procedures were followed.
I researched this a while ago and saw cases saying that liability cannot be based solely on an administrative position, but my client did issue otders?
