If it is sworn testimony in a proceeding that is not sealed or otherwise covered by a confidentiality agreement, then the only other issue I can think of is the timely disclosure of party statements.

We have a case in which the plaintiff has another unrelated action pending in which depositions have been taken, but the transcripts have not been filed in NYCEF. Are those depositions usable as exhibits to a motion in our case or does plaintiff have a confidentiality argument against us doing that?
